Commissioner of Oaths

The Township of Hamilton provides Commissioner of Oaths services through the Corporate Services Department. Under the Commissioners for Taking Affidavits Act, Municipal Clerks and designated officials are authorized to take affidavits, administer oaths, and witness or certify certain documents.

We recommend making an appointment to ensure availability. Services are offered at the Commissioner’s discretion, and not all documents may be eligible for signing.

What is a Commissioner of Oaths?

A Commissioner of Oaths is authorized under the Commissioners for Taking Affidavits Act to administer oaths, take sworn declarations, and certify specific documents. This service is often needed for government or legal paperwork.

Not a Notary Public

We do not provide Notary Public services. If your document must be notarized, you’ll need to contact:

  • A private lawyer
  • A Justice of the Peace
  • A licensed Notary Public in Ontario

Notaries can be found online or in your local directory.

Please note: Commissioners will not sign documents related to wills, testaments and estates, powers of attorney, divorce, separation, custody, real estate, travel, vaccination status/exemptions, and court related documents.

Our Commissioners may sign certain documents, including:

  • Proof of residency
  • Transfer of vehicle ownership
  • Pension or insurance claim forms
  • Municipal and government-related forms
  • Certification of documents as “true copies”
  • Certification of an identifiable individual’s signature

All services are provided at the Commissioner's discretion.


We are not authorized to sign or certify documents related to:

  • Wills, testaments, or estates
  • Powers of attorney
  • Divorce, custody, or separation agreements
  • Real estate transactions
  • Travel letters or vaccination status/exemptions
  • Court proceedings or legal filings

If your document falls into one of these categories, please contact a Notary Public, lawyer, or Justice of the Peace for assistance.

Before Your Appointment

Please ensure the following before your visit:

  • Do not sign your document in advance. It must be signed in front of the Commissioner.
  • The person(s) making the declaration must be present. If the document requires two signatures, both parties must be present for signatures to be witnessed by the Commissioner.
  • You must bring valid government-issued photo ID that shows your full name, address, and signature. Photocopies are not accepted.

The fee for Commissioning of Oath services is $5.00 per document for residents and $15.00 per non-resident and business entities.
